Terms and Conditions

1. Introduction & Acceptance

These Terms of Service ("Terms") are a legally binding agreement between you ("you", "your") and Collect Fun Pte Ltd (UEN 202534309H) of 601 MacPherson Road #05-01, Singapore 368242 ("Collect Fun", "CollectFUN!", "we", "us", "our").

These Terms govern your access to and use of our websites, mobile applications and online services (the "Platform") and all products and services we provide through the Platform (the "Services"), including: (i) an online marketplace for buying, selling and trading collectible cards and memorabilia; (ii) Vault services (physical custody of cards you own); (iii) Digital Wallet functionality for Platform transactions; and (iv) the FUNPack! experience (defined below).

By accessing or using the Platform/Services, you agree to these Terms and our Privacy Policy (collectively, the "Agreement"). If you do not agree, do not use the Platform/Services.

3. Eligibility & Accounts

3.1 Eligibility

You must have legal capacity under Singapore law and be at least 18 years old to use the Services. If you are between 18 and 20, you confirm you have authority to enter into these Terms (e.g., parental/guardian consent where required). Business users confirm they are duly authorised to bind their entity.

3.2 Account Information

Provide accurate, current, and complete information, keep it updated, and promptly provide verification materials we reasonably request (e.g., ID, address). We may decline, suspend, or terminate Accounts at our discretion.

3.3 Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities under your Account. Notify us immediately of any unauthorised use.

3.4 Prohibited Conduct

You agree not to: (a) violate any applicable law or these Terms; (b) infringe intellectual property or privacy rights; (c) upload unlawful/defamatory/obscene content; (d) scrape, crawl, harvest, reverse engineer, or overload the Platform; (e) use bots to send excessive messages; (f) interfere with security or integrity; (g) mislead about identity or affiliation; (h) sell items you do not own or are not authorised to sell; (i) attempt to build a competing service using the Platform.


4. The Services

4.1 Marketplace

We provide a marketplace to list, buy, sell, and trade cards and memorabilia. Transaction flows may include Buy-Now, Offers/counter-offers (cash and/or card components), and Auctions. Highest bidders must complete payment within the stated time. We may change features/fees at any time (see Clause 8).

4.2 Vault (Physical Custody)

(a) Custody; Ownership. We physically hold cards you own in our custody locations. Title to vaulted cards remains with you.

(b) Care; Security. We use industry-standard measures (physical, electronic, and access controls) to protect vaulted items.

(c) Insurance. We maintain insurance for the vault facility; coverage may be subject to caps, exclusions, and valuation methods set out on the Platform. You are responsible for declaring accurate item details and for any excess value or categories excluded by our insurer.

(d) Submission & Return. You are responsible for shipping cards to us until received at our facility. You may request retrieval/return at any time via the Platform, subject to fees, identity checks and shipping limits (see FAQ).

(e) Inspection; Rejection. We may refuse custody of items at our discretion (e.g., suspected counterfeit/illicit items or unsafe packaging) and return them at your expense.

4.3 No Grading

We do not provide grading services. Any descriptors we display (e.g., set, print, apparent condition) are informational and not a warranty or valuation.

4.4 FUNPacks! (Randomised Packs)

(a) Experience. A FUNPack! is a paid, randomised pack of physical cards whose specific contents are revealed digitally after purchase. We disclose composition parameters (e.g., set categories, possible tiers, odds ranges) on the Platform.

(b) Final Sale. FUNPack! purchases are final and non-refundable except as required by law or expressly stated on the Platform.

(c) No Gambling. FUNPack! are a sale of goods with variable contents, not a wager or prize draw; they do not award cash or monetary prizes.

(d) Inventory & Termination. We may end a FUNPack! series when inventory is depleted, including if headline items remain undistributed. Purchasing a FUNPack! grants you the experience; you obtain rights only in the specific cards revealed to you.

(e) Post-Reveal Choices. After reveal, items are added to your account inventory; you may request retrieval from the Vault (subject to availability, shipping, and fees).


5. Service Availability

We aim to keep the Platform and Services available at all times, but do not guarantee uninterrupted access. Maintenance, updates, or unexpected outages may temporarily affect availability. We will use reasonable efforts to restore access promptly. We are not liable for any loss or inconvenience arising from downtime or service interruptions.


6. Buyers

6.1 Finality

Unless our refund policy expressly provides otherwise or required by law, purchases on the Platform are final.

6.2 Accuracy & Variances

We strive for accuracy but make no guarantee that Platform information is error-free. Where an item you receive materially differs from the listing due to our error, contact us within 3 business days of receipt; our remedies may include repair, replacement, partial refund/credit, or rescission (caps/eligibility may apply; details on the Platform). Removing items from original tamper-evident cases may void remedies.

6.3 Compliance

You are responsible for complying with applicable import/export, customs, and tax obligations for your purchases and for any local legal restrictions on ownership.


7. Content & IP

7.1 Your Content

You remain responsible for and retain ownership of content you post (listings, images, descriptions, comments) ("User Content"). You grant us a worldwide, royalty-free, transferable, sublicensable, irrevocable, perpetual licence to use, host, reproduce, display, adapt, distribute, and create derivative works from your User Content for operating, improving, and promoting the Services.

7.2 Public Nature

User Content may be public. Do not share confidential information through the Platform.

7.3 Our IP

We (or our licensors) own the Platform, UI, software, databases, designs, trademarks and all related intellectual property. You may not copy, modify, reverse engineer, or create derivative works except as permitted by law or these Terms.

7.4 IP Complaints (Singapore)

If you believe content infringes your rights under the Singapore Copyright Act 2021 or other IP laws, email [email protected] with: (i) your contact details; (ii) description of the work/mark; (iii) URLs/screenshots identifying the infringing material; (iv) a statement of ownership and good-faith belief of infringement; and (v) a statement that information provided is true and accurate. We may remove or disable access and notify the affected user. We may accept counter-notices and, where appropriate, restore content.


8. Fees, Taxes, and Changes

8.1 Fees

We may charge fees for transactions, vaulting, storage, retrieval, shipping/handling, FUNPacks!, and other services. Fees are disclosed at checkout or in the FAQ and may change at any time.

8.2 Currency & Taxes

Unless stated otherwise, prices and fees are in Singapore dollars (SGD) and subject to GST where applicable. You are responsible for any additional taxes, customs, or duties.

8.3 Changes to Services/Fees

We may add, remove, suspend, or modify any Service or fee at any time.


9. Payments & Digital Wallet

9.1 Third-Party Processor

All payments, payouts and wallet flows are provided by a licensed third-party payment service provider (e.g., a Payment Services Act (Cap. 2) regulated entity). You must maintain an active account with that provider and comply with its terms and privacy policy.

9.2 Closed-Loop Wallet

The Digital Wallet is a closed-loop ledger for Platform transactions. Wallet balances: (a) are funded only via approved methods through the third-party provider; (b) may be used solely within the Platform; (c) are not bank deposits, do not earn interest, and are not insured by SDIC; and (d) may be subject to limits, holds, or delays to prevent fraud or comply with law.

9.3 Custody of Funds

CollectFUN! does not hold or transmit customer funds. All inflows/outflows are processed by the third-party provider. We maintain an internal ledger only.

9.4 Errors & Disputes

Report suspected unauthorised transactions promptly to [email protected]. We will investigate in good faith and respond within a reasonable time.

9.5 Dormant Wallets

If your Wallet is inactive for a prolonged period, we will attempt to contact you using your registered details. Where required by law, we may remit unclaimed balances or take actions consistent with applicable rules.


10. Shipping, Risk, and Title

10.1 Risk of Loss

Risk transfers to us only when items are received at our designated facility; risk transfers back to you upon dispatch to you/your carrier for returns or retrievals.

10.2 Customs & Import

You are responsible for import/export compliance, declarations, and duties for cross-border shipments.

10.3 Restrictions

Shipping destinations, carriers, insurance options, and cut-offs are as stated on the Platform and may change.


11. Third-Party Services & Links

You may access third-party services (e.g., payment provider, messaging, social networks) via the Platform. We are not responsible for third-party services or content; your use is governed by their terms/policies.


12. Warranty Disclaimers

To the maximum extent permitted by Singapore law, the Services and all content are provided "as is" and "as available" without warranties of any kind, express, implied, or statutory, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee continuous, error-free, or secure access; marketplace outcomes; item authenticity, condition, or value; or accuracy/completeness of listings.

Nothing in these Terms limits any non-excludable rights under the Consumer Protection (Fair Trading) Act 2003, the Sale of Goods Act 1979 (as applicable in Singapore), or other mandatory laws.


13. Limitation of Liability

13.1

To the maximum extent permitted by the Unfair Contract Terms Act 1977 (Cap. 396) and other applicable laws, we are not liable for: indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, data, goodwill; or procurement of substitute goods/services, arising from or related to the Services or these Terms.

13.2 Exclusions

The above limits do not apply to liability that cannot be excluded/limited under law (e.g., death or personal injury caused by negligence, fraud).


14. Indemnity

You will indemnify, defend, and hold harmless CollectFUN!, its directors, officers, employees, and agents from any claims, losses, liabilities, and costs (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your User Content; (c) your breach of these Terms; (d) your violation of law or third-party rights.


15. Suspension, Termination, and Abandonment

We may suspend or terminate your Account/Services for any reason, including suspected fraud, non-payment, or legal risk. You may close your Account at any time.

Abandoned Vaulted Items. If, for 12 consecutive months, you take no action on vaulted items and fail to respond to our outreach over a subsequent 90-day notice period (using your last known contact details), you authorise us to: (i) exercise a lien for unpaid fees, storage, and costs; and (ii) sell items in a commercially reasonable manner to cover amounts owed. Surplus proceeds (if any) will be held for you for one year and then may be forfeited if unclaimed, to the extent permitted by law.


16. Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect personal data in accordance with the Personal Data Protection Act 2012 (PDPA). By using the Services, you consent to our processing consistent with that policy and the PDPA.


17. Disputes: Governing Law & Arbitration

17.1 Governing Law

This Agreement is governed by the laws of Singapore, without regard to conflict-of-laws principles.

17.2 Good-Faith Resolution

Please contact [email protected] to try to resolve issues informally.

17.3 Arbitration

Any dispute, controversy, or claim arising out of or relating to this Agreement, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (SIAC) in accordance with the SIAC Rules for the time being in force, which rules are deemed to be incorporated by reference.

17.4 Injunctive Relief

We may seek equitable relief in Singapore courts to protect IP, security, or confidentiality.

17.5 Non-Class Proceedings

Proceedings will be conducted on an individual basis only.


18. Changes to these Terms

We may update these Terms by posting the revised version on the Platform with "Last Updated" date. Changes take effect upon posting unless stated otherwise. If you continue using the Services after changes take effect, you accept the updated Terms.


19. General

19.1 No Professional Advice

Information on the Platform is general information only and not legal, tax, investment, or other professional advice.

19.2 Severability; No Waiver

If any provision is invalid, the remainder remains effective. Our failure to enforce a provision is not a waiver.

19.3 Assignment

You may not assign or transfer your rights or obligations without our prior written consent. We may assign to an affiliate or in connection with a reorganisation, merger, or sale.

19.4 Notices

We may notify you via the Platform, email, or postal mail. You may contact us at [email protected] or at our registered address.

19.5 Entire Agreement

These Terms and the Privacy Policy are the entire agreement regarding the Services and supersede prior understandings.
